This privacy policy (“Policy”) describes how Workplace Options LLC and our entities globally (“WPO”, “we”, “us” or “our”) collects, protects and uses the personally identifiable information (“Personal Information”) you (“User”, “you” or “your”) may provide while using any of its products or services (collectively, “EAP Services” or “Services”). This includes services delivered on behalf of Jorgensen Brooks Group Employee Assistance Programs (EAP). It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

WPO is committed to protect all personal and private information in accordance with any and all applicable laws, regulations and standards, including without limitation any standards established in the United States under the Health Insurance Portability and Accountability Act, HITECH (Health Information Technology for Economic and Clinical Health Act), and in the United Kingdom under the Data Protection Act of 2018. In case of use of our services within the European Union, WPO is subject to the General Data Protection Regulation (Regulation (EU) 2016/679), effective as of May 25, 2018, Australia’s Privacy Act and any national legislation implementing the foregoing. The legal basis of EU-US data transfer is based on EU Model Clauses (Standard Contractual Clauses) and the derogations as per Art.49 of GDPR. WPO is liable for in cases of onward transfers to third parties.

Workplace Options LLC (WPO) complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. WPO has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. WPO has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Workplace Options commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs) and the UK Information Commissioner’s Office (ICO) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF.

Workplace Options is under the investigatory and enforcement powers vested in the Federal Trade Commission (FTC). In alignment with our unwavering commitment to privacy and strict adherence to pertinent regulations, we expressly recognize and acknowledge the regulatory oversight exercised by the FTC in matters pertaining to the safeguarding of personal information. In cases of onward transfers to third parties, Workplace Options assumes full responsibility and remains liable for the protection of your personal information. We undertake rigorous due diligence to ensure that any third party receiving such information maintains a level of data protection consistent with our privacy standards. This commitment is in accordance with applicable data protection laws and regulations, reflecting our dedication to safeguarding your privacy throughout the entire data transfer process.

Mobile Application

Apart from the data mentioned above, WPO may collect additional data depending upon the platform which you use to connect to WPO (Mobile application, Teams App etc). When you use the Mobile Application, including the app provided as part of the Jorgensen Brooks Group Employee Assistance Programs (EAP), our servers automatically record information that your device sends. This data may include information such as your device’s IP address and location, device name and version, operating system type and version, language preferences, information you search for in our Mobile Application, access times and dates, and other statistics. You will be able to control the permissions for location and other device-specific parameters based on your device (e.g., location, notification). If you choose not to allow this access, some services may not operate effectively as expected.

If you wish to use the Mobile Application’s features, you will be asked to provide certain Personal Information (for example, your name and e-mail address). We receive and store any information you knowingly provide to us when you create an account or fill any online forms in the Mobile Application. When required, this information may include your email address, name, phone number, or other Personal Information to complete the registration. If you choose not to provide us with your Personal Information, then you may not be able to take advantage of the Mobile Application’s features.

The Jorgensen Brooks Group EAP mobile application is developed by Machuca Design, LLC. By using this app, you agree to this Privacy Policy and any other applicable terms.
